Detailed
Description
Against Teshuvot be-Anshei Aven, an anti-Reform polemic, by R. Phinehas M. Heilpern. This polemic is divided into three sections. The first deals with the issue of textual emendations in the Talmud which the author believes should be limited to those emendations already suggested by the medieval Talmudists. The second part suggests that one should accept the conclusions of the Talmud even if these are counter intuitive. The third and most polemical section of this book is an attack based on the first two sections against Pinchas Menachem Heilprin (1801-1863) who had suggested in his book Teshuvot be-Anshei Aven that civil marriages might be permissible under Jewish law even though this conflicted with the Talmudic dictum:דכל דמקדש אדעתא דרבנן מקדש ואפקעינהו רבנן לקדושין מיניה. Heilprin had suggested that not all Talmudic ideas were meant to endure beyond Talmudic times and that if they seemed not to make sense it was perfectly legitimate to emend the text accordingly. Heilprin was hardly a reformer and the EJ suggests that: ‘the moderation of his critical views on talmudic literature stemmed from a loyalty to Jewish tradition’.

R. Isaac Zevi b. David Margaretten (1808-1850) was born in Orshah Abraham, Transylvania and educated in major Hungarian Yeshivot. He was rabbi in Felsoabrany, Hungary and wrote several scholarly works of which only Bet David (Bratislava 1846) was printed.
