Description

Rare edition of the responsa of R. Joel ben Samuel Sirkes (1561–1640), known as the Bah (for Bayit Hadash), after this, his most famous work. This edition is of particular interest due to the ornate title page and the reasons for its rarity. The title page has an elaborate frame embellished with numerous figures of unclothed women, satyrs, and mythological figures. This title page aroused the opposition of the Frankfort rabbis, who considered the title page inappropriate and offensive to Jewish sensibilities. They banned the sale of the book with this title page, so that the printer had to replace the entire first quire of the book, headed by a more suitable title page. The replacement page is simple, consisting of two cherubim holding a wreath in which the text is set. That second title page is quite common, in contrast to this title page which is understandably quiet scarce. Published posthumously, the title page states that these are the responsa of R. Sirkes who served as rabbi in several communities, among them Cracow, where he, “built a new house (bayit hadash)” (Deuteronomy 20:5). The manuscript was brought to press by the widow of R. Meir Stern, the daughter of R. Mendlen Bass (a student of Bah). It is dated, “The wisdom of women builds בנתה (457 =1697) her house” (Proverbs 14:1). She’elot u’Teshuvot Bayit Hadash consists of one hundred fifty-eight responsa. The subject matter encompasses prayers; Shabbat; festivals; milah; laws of mourning; betrothal, matrimony and divorce; fines, punishments, and bans; dietary laws, financial matters; first born of animals; and interest. E. J. Shochet suggests that the editors abridged some responsa and took license with others, although in most cases he (they) were primarily copyists. There is duplication among the responsa and for ten responsa, apart from being in the collection, “there is nothing to indicate that they are by Sirkes.” The responsa in Bayit Hadash are lengthy but without extraneous material, detailed but not verbose, reflecting Bah’s encyclopedic knowledge of rabbinic literature.

המביא לדפוס מספר שכתב היד היה ברשותו של ר' מנדלן בס, תלמידו של המחבר, וממנו עבר לחתנו ר' מאיר שטערן. אלמנתו של האחרון (חמותו של המביא לדפוס) יזמה את הדפסת הספר. המביא לדפוס ערך את הספר ותרגם קטעים בלשון יידיש ללשון הקודש, "לכבוד חכמי ספרדים" (בסוף הספר). דף [2] בראש הספר: הסכמות והקדמת העורך והמביא לדפוס, ר' שלמה זלמן ב"ר שמעון דעלם [שטיינשניידר גורס: דעלס] מפרנקפורט. דפים [6-3]: מפתחות. [2] דף בסוף הספר: "שאלות ותשובות מועתקים מלשון אשכנזי ללשון הקודש" (תרגום של גביות עדות בעניני עגונות) ו"לוח הטעות". עיין על התרגום: שמואל ק. מורסקי , ר' יואל סירקש, חורב, ו, תש"ב, עמ' 67, הערה 95. השער מוקף מסגרת של זר ענפים ופרחים, ומעל המסגרת מצויירים שני כרובים. ראינו טופס שונה: השער מוקף מסגרת עם דמויות רבות, מעורטלות. בטופס זה יש בראש הספר [4] דף בלבד (במקום 6). נשמטו ההסכמות והקדמת המביא לדפוס. המפתחות נדפסו מחדש.
